“DBS x AlipayHK Taobao Double 11 Limited-time Offer” Terms and Conditions

1. DBS x AlipayHK Taobao Double 11 Limited-time Offer (“Promotion”) is only applicable to the principal and supplementary cardholders of DBS Credit Cards and Co-branded Cards (excluding Private Label Cards, Business Cards and DBS Black American Express^® Card) (“Applicable Credit Cards”) issued by DBS Bank (Hong Kong) Limited (the “Bank”) ("Cardholders").
2. The promotion period is from 11 November, 2021 00:00 - 23:59 (Hong Kong Time) (“Promotion Period”). All Eligible Transactions (based on transaction dates, as set out in Clause 7) must be conducted during the Promotion Period.
3. During the Promotion Period, Cardholders are entitled to an instant discount of HK$11 (“Offer”) upon making a single net spending of HK$100 or above at Taobao/Tmall Platform (as defined in Clause 4) with an Applicable Credit Cards via AlipayHK mobile application (“AlipayHK App”) (“Eligible Transaction”). The amount of single net spending shall be determined based on the real-time exchange rate in the AlipayHK system at the time of the transaction. The “Currency” tool in the AlipayHK App is for reference only.
4. “Taobao/Tmall Platform” refers to the Taobao (not including Taobao Lite) or Tmall shopping platform which must be accessed through the Taobao mobile application.
5. Cardholders are required to successfully bind their Applicable Credit Cards to their AlipayHK accounts in the AlipayHK App and make an Eligible Transaction in order to enjoy the Offer.
6. A "single net spending” refers to the final posted net purchase amount made with an Applicable Credit Cards at Taobao/Tmall Platform in a single transaction during the Promotion Period (based on transaction dates). The Offer may be used in conjunction with red packets, merchant discounts, shopping rewards, etc. on Taobao.com or Tmall.com, subject to the actual payment page which shall prevail. Offer is limited to the first 30,000 Eligible Transactions completed by Applicable Credit Cards during the Promotion Period. Each Cardholder can enjoy the Offer once only. Offer is on a first-come, first serve basis and will be available until quota lasts. AlipayHK’s records shall prevail under any circumstances.
7. For the avoidance of doubt, the Offer is not applicable in the following circumstances on Taobao.com or Tmall.com: non-mobile app paying order, Taobao (Xianyu)’s order, virtual goods (including but not limited to anything that does not require shipment such as virtual currency, prepaid cards, etc.), or any other circumstances as specified by Taobao.com or Tmall.com.
8. Regarding to AlipayHK App, each AlipayHK user refers to a natural person with legal capacity who uses the AlipayHK App and Wallet service, but not merely an AlipayHK account. To further avoid any dispute, in the following circumstances, the relevant accounts will be deemed to be used by the same user and can only participate in this promotion once:
   1. Connection on the same mobile phone or mobile device, such as the logging in or activation of multiple accounts; or
   2. Connection of an AlipayHK account or mobile number on multiple mobile phones or mobile devices, such as the logging in or activation on such devices; or
   3. The same credit card number being connected to multiple AlipayHK accounts.

   In the case of any of the above, in order to verify the AlipayHK user’s identity and prevent the risk of theft or misuse of such AlipayHK account, mobile phone number, mobile device or credit card number, AlipayHK reserves the right to suspend or terminate the release of the Offer to the relevant account and to take legal action.

9. If there is any breach of these terms and conditions or illegal, fraudulent or abusive behavior during the use of any Offer, or if any user commits any act affecting other users’ ability to participate in the Promotion fairly, AlipayHK will forfeit such user’s Offer and the entitlement of Offer forthwith without notice, and reserves the right to cancel such transaction and to take legal action against the relevant user.
10. The Offer is not exchangeable for cash or other items and is non-transferable. For goods return or refund, the amount on the Offer will not be returned and the Offer will not be re-issued.
11. No person other than the Cardholders, the Bank or AlipayHK will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce or enjoy the benefit of any of the provisions of these terms and conditions.
12. AlipayHK, Taobao.com, Tmall.com and the Bank will carry out this promotion in accordance with applicable laws. If the promotion cannot be carried out smoothly due to a force majeure event, AlipayHK, Taobao.com, Tmall.com and the Bank cannot be held liable for any damage, loss or dispute therein. A force majeure event is regarded as any government orders, damaging cyberattack, electronic system failure or circumstance beyond the control of AlipayHK, Taobao.com, Tmall.com or the Bank.
13. The sellers and merchants on Taobao.com or Tmall.com shall take the responsibility of selling procedures and after-sales services. AlipayHK, Taobao.com, Tmall.com and the Bank do not participate in the selling procedures and cannot be held liable for the product quality and availability.
14. AlipayHK and the Bank reserve the right to change, suspend or terminate the promotion or its terms and conditions at its sole discretion. AlipayHK and the Bank shall not be liable for such change, suspension or termination and reserve the right of final decision of all the matters and disputes.

16. These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
17. Should there be any discrepancy or inconsistency between the English and the Chinese versions of these terms and conditions, the English version shall prevail.

 

General Terms and Conditions for DBS Credit Card Offers

1. Unless otherwise specified, the promotion offers published in this webpage ("Offers") are only applicable to the cardholders of DBS Credit Cards and Co-branded Cards and DBS COMPASS VISA (excluding Business Card and Private Label Card) (“Applicable Credit Cards”) issued by DBS Bank (Hong Kong) Limited (the “Bank”) (“Cardholders”).
2. To enjoy the Offers, Cardholders are required to settle payment with the Applicable Credit Cards.
3. For Cardholders holding DBS Black American Express^® Card, Offers are applicable to them only at merchants’ outlets (either physical or online) accepting American Express^® Card for payment.
4. Certain Offers are not valid on public holidays, eves of public holidays, festive days, eves of festive days and black-out days as designated by the merchants. Please contact the respective merchants for details.
5. Cardholders should confirm the Offers with the respective merchants before payment. Unless otherwise specified, the Offers are only applicable to the respective merchant outlets in Hong Kong.
6. Unless otherwise specified, the Offers are applicable to regular-priced items only and not applicable to fixed-priced, discounted, consignment, promotional, festive and designated items/services. The Offers cannot be used in conjunction with other promotional offers or discounts, coupons or membership offers.
7. Advance appointment with mentioning of using the Offers during reservation may be required for specific merchants. Please call the respective merchants for details in advance.
8. Unless otherwise specified, the Offers related to dining are not applicable to take-away items, set menu, discounted dishes, room services, meetings, private functions, banquets, catering services, happy hours, charge for tea and condiments and 10% service charge.
9. All products and services are subject to availability while stocks last.
10. The prices of all products and services published in this webpage are for reference only. No notice will be made should there be any changes.
11. The Bank is not the supplier of the products/services or the description, photos or reference prices (if any) in relation to the products/services published in this webpage (which are intended to be for reference only). Any enquiry, claim or complaint in relation to the quality or availability of the products/services or the accuracy of any of the aforementioned information contained in this webpage shall be directed to the relevant merchants. The Bank shall assume no liability in respect thereof.
12. The Bank will not accept any liability for any loss incurred by Cardholders should the respective merchants refuse to provide the Offers.
13. Besides these terms and conditions, each Offer is subject to specific terms and conditions applicable to it.
14. A person who is not a party to these terms and conditions may not enforce any of their terms under the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the Laws of Hong Kong).
15. The Bank and the respective merchants may change these terms and conditions and/or modify or terminate the Offers. The Bank’s and the respective merchant’s decision are final.
16. The English version shall prevail if there is any inconsistency between the English and Chinese versions.
