Welcome Offer Promotion for New Octopus on iPhone and Apple Watch Customers Terms and Conditions

  1. This “Welcome Offer Promotion for New Octopus on iPhone and Apple Watch Customers” (this “Promotion”) is organised by Octopus Cards Limited (“OCL”) and open to Visa credit or debit cardholders and customers of Apple Pay, a mobile payment and digital wallet service by Apple Inc. (“Apple”) (collectively, “Apple Pay Customers”, each, “Apple Pay Customer”) using Apple Wallet, a mobile application operated by Apple (“Apple Wallet”).
  2. By participating in this Promotion, each Apple Pay Customer is deemed to have read, accepted and agree to be bound by these Terms and Conditions. OCL reserves the right to amend these Terms and Conditions at any time, without prior notice.
  3. Conditions of Issue of Octopus, Terms of Use of Octopus App and other terms and conditions of use published by OCL at www.octopus.com.hk and/or in Octopus App, as amended from time to time, shall apply to this Promotion.
  4. “Octopus App” referenced in these Terms and Conditions is defined as “Octopus Mobile App” in the Conditions of Issue of Octopus. “Octopus” and “Smart Octopus” referenced in these Terms and Conditions are defined in the Conditions of Issue of Octopus.
  5. The promotion period of this Promotion will commence at 00:00 on 15 April 2021 (Hong Kong time) and end at 23:59 on 31 May 2021 (Hong Kong time) (“Promotion Period”).
  6. To participate in this Promotion, an Apple Pay Customer using iPhone 8 or above, or Apple Watch Series 3 or above (collectively, “Eligible Devices”, each, an “Eligible Device”) and signed in to Apple Wallet with Apple ID (“Apple ID”), has to be a holder of a valid Visa credit or debit card (collectively, “Visa”) in Apple Wallet.
  7. Subject to these Terms and Conditions (including Clauses 8, 9, 10, 11, 12, 13 and 14), each Apple Pay Customer who:
    1. has not added any Octopus to his/her Eligible Device prior to the start of the Promotion Period;
    2. has successfully added a valid Octopus (designated as a Smart Octopus) on his/her Eligible Device via Apple Wallet or Octopus App (“Eligible Smart Octopus”), and has topped up the Eligible Smart Octopus using Visa via Apple Wallet or Octopus App with an initial top up amount of HK$200 or above (not include deposit of HK$50) during the Promotion Period; and
    3. has registered for this Promotion during the Promotion Period by providing the Octopus number of his/her Eligible Smart Octopus on the Promotion website at https://www.octopus.com.hk/pg/202104APO;

    will be considered a successful participant of this Promotion (each, a “Participant”) and will be eligible to receive a welcome offer of HK$50 Octopus top-up value (“Offer”).

  8. The Offer is limited and will be offered on a first-come-first-served basis. OCL will announce on OCL’s website www.octopus.com.hk if the Offer runs out.
  9. Any Octopus which is added on an Eligible Device previously being issued with another Octopus, or is added to any Eligible Device using the Apple ID which had previously issued another Octopus before the Promotion Period will not be considered as an Eligible Smart Octopus.
  10. Each Participant is eligible to the Offer once only under this Promotion. If more than one Eligible Smart Octopus is added on the same Eligible Device or added with the same Apple ID during the Promotion Period, only the first Eligible Smart Octopus added on the same Eligible Device or same Apple ID will be entitled to the Offer.
  11. Any Octopus added on an Eligible Device via Octopus App for Tourists or any Octopus added on an Eligible Device using non-Hong Kong issued Visa credit or debit card is not considered as an Eligible Smart Octopus in this Promotion.
  12. To collect the Offer, each Participant is required to (a) register his/her Eligible Smart Octopus on Octopus App and (b) opt-in for push notifications on Octopus App in order to receive push notifications. Each Participant will be notified by push notification through Octopus App during 12 June 2021 to 16 June 2021 that the Offer will be made available for collection through Octopus App onto his/her said Eligible Smart Octopus.
  13. The Offer will be made available for collection until and including 11 July 2021. The Offer will be forfeited automatically without notice if: (a) the Participant fails to collect the Offer on or before 11 July 2021, or (b) the said Eligible Smart Octopus of the Participant has been removed, refunded, suspended or cancelled or is no longer valid for whatever reason(s) at the time of collection; which, under no circumstance shall any claim be made against OCL whatsoever. OCL shall not bear any responsibility or liability whatsoever if any Participant fails or is unable to collect the Offer under whatever circumstance, including, but not limited to, due to reset of Apple Wallet or Apple ID, suspension, cancellation or termination of Eligible Smart Octopus for whatever reason, loss of Eligible Device, or device reset due to factory data reset or Find My iPhone.
  14. OCL reserves the right to disqualify any Apple Pay Customer or Participant committed or suspected of fraud, or if OCL believes that an Apple Pay Customer’s or a Participant’s participation in this Promotion has been manipulated in any way by machines or computers. Any transaction that is found to be fraudulent will result in the relevant Eligible Smart Octopus, Apple Pay Customer and/or Participant being disqualified from participating in this Promotion.
  15. By participating in this Promotion, each of the Apple Pay Customers and the Participants under this Promotion agrees that his/her Eligible Smart Octopus number and details of any initial top up amount and transaction, collected in connection with this Promotion or the Offer will be used and retained by OCL for the purpose of this Promotion for (a) verifying an Apple Pay Customer’s or a Participants’ eligibility, (b) notifying a Participant of the Offer, and (c) handle any enquiries or resolving any disputes. Any information collected by OCL as aforesaid in connection with this Promotion or the Offer will be retained for 6 months after the end of the Promotion Period (“retention period”) and will be destroyed on expiry of the retention period.
  16. OCL reserves the right to change or substitute the Offer to other offer of a comparable or equivalent value if it deems fit. The Offer is not exchangeable for cash.
  17. In the event of any dispute arising from this Promotion or relating to the interpretation of these Terms and Conditions, the decision of OCL shall be final and binding on all parties.
  18. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond OCL’s and Visa’s reasonable control (including force majeure events, etc.), each of OCL and Visa reserves the right, in its sole discretion and to the fullest extent permitted by applicable laws, to modify, suspend, terminate or cancel this Promotion, in whole or in part, as appropriate. Under no circumstance shall OCL and/or Visa be responsible or liable to any Apple Pay Customer, Participant or any other person or entity whatsoever relating to or in connection with this Promotion.
  19. OCL makes no guarantee of the availability of Octopus App and will not be held responsible for interruption of service that may interfere with the ability of any person to participate in this Promotion.
  20. Except for any liability that cannot be excluded by law, each of OCL (including its officers, employees and agents) and Visa excludes any and all liability (including in negligence), for any personal injury, or any loss or damage (including loss of profit, loss of opportunity, etc.), whether direct, indirect, special or consequential whatsoever, arising in any way out of or relating to this Promotion, including but not limited to the followings: (a) any technical difficulties or equipment malfunction (whether or not under OCL's control); (b) any theft, unauthorised access or third party interference; (c) any transaction, claim or Offer that is late, lost, altered, damaged or misdirected (whether or not after receipt by OCL) due to any reason beyond the reasonable control of OCL; (d) any variation to the Offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by any Apple Pay Customer and/or Participant; or (f) use of any of the Offer.
  21. Each of the Apple Pay Customers and Participants agrees to indemnify and hold OCL harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from the alleged or actual infringement of any third party copyright, patent, trademark or other intellectual property rights, or other rights, any breach of these Terms and Conditions and/or arising out of or in connection with this Promotion.
  22. Except where expressly provided herein, each of the Apple Pay Customers and Participants shall bear his/her own costs and expenses incurred and/or arising from his/her participation in this Promotion, and no reimbursement may be sought from OCL and/or Visa whatsoever.
  23. No person other than the Participant and OCL will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce any of the provision of these Terms and Conditions.
  24. In case of any inconsistency or discrepancy between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.
  25. These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict or choice of law provisions.
  26. Except as expressly stated herein, OCL will not provide your personal information to any third parties without your consent. In addition, OCL will not sell or disclose, by any method, information on the Participants under this Promotion and personal information of visitors to this website. "eWallet Top-up Up To HK$120 Offer" Terms and Conditions

  1. The “eWallet Top-up Up To HK$120 Offer” (“Promotion”) is only applicable to the principal cardholders of DBS Credit Cards and Co-branded Cards (excluding Private Label Card and Business Card) (“Cardholder”) issued by DBS Bank (Hong Kong) Limited (“The Bank”) (“Applicable Credit Cards”). This Promotion is not applicable to DBS Black American Express® Card and supplementary card cardholders.
  2. The promotion period for the Promotion is from 4 January 2021 to 30 June 2021, both dates inclusive (“Promotion Period”).
  3. During the Promotion Period, Cardholder binds Applicable Credit Cards via AlipayHK, PayMe, WeChat Pay HK and/or Octopus on Apple Pay (“Designated eWallet”) for the first time and top-up HK$500 or above (net single top-up amount) (including transfer top-up) (“Eligible Transaction”) to the Designated eWallet can enjoy HK$30 deduction for that transaction through the Red "InstaRedeem" function of DBS Card+ mobile application (“DBS Card+”) (“Offer”) after the transaction posted and displayed in Timeline of DBS Card+. Individual eWallet may charge handling fee during top-up.
  4. Offer is only applicable to the Cardholders who did not make any transactions with any Applicable Credit Cards at AlipayHK, PayMe, WeChat Pay HK and/or Octopus on Apple Pay respectively in the past 12 months prior to 31 December 2020.
  5. Each DBS Card+ user can enjoy the Offer once for each Designated eWallet (Once each for AlipayHK, PayMe, WeChat Pay HK and Octopus on Apple Pay, in a total of 4 times).
  6. Offer is limited to the first 12,000 Eligible Transactions. Offer is on a first-come first-serve basis and is available until the quota is full.
  7. The transaction post time and display time on DBS Card+ Timeline will vary depending on the merchant category, payment returning time from merchant or payment gateway.
  8. To enjoy the Offer, Cardholders are required to install the DBS Card+ and completely register an DBS Card+ account, and turn on the notification in the menu of DBS Card+ by selecting Setting > Push Notification > “InstaRedeem” before conducting any Eligible Transactions. Cardholders must enjoy the Offer on or before 14 July 2021 23:59 (Hong Kong Time); otherwise, it is considered as giving up the Offer on its own.
  9. The Offer of this Promotion cannot be enjoyed in conjunction with other “InstaRedeem” promotion offers offered by the Bank and the merchants. If Customer’s spending meets the requirements of other "InstaRedeem" promotion offer at the same time, the Bank has the right to determine which offer to be awarded in respect of that spending. When the spending has already been awarded under the Offer of this Promotion, the same spending cannot be awarded again under other "InstaRedeem" promotions and vice versa. In case of any disputes, the Bank reserves the right of final decision.
  10. Offer is only applicable to Cardholders whose Applicable Credit Card accounts are valid, not in default and in good standing (as determined by the Bank at its sole discretion) during the Promotion Period. If the status of a Cardholder’s Applicable Credit Card account is not in good standing, the Bank reserves the right to disqualify the Cardholder from participating in the Promotion and/or enjoying the Offer.
  11. The Offer entitled by Cardholders shall be determined by the Bank at its sole discretion based on the Bank’s record. Cardholders must retain the original transaction slips of any transactions. In case of any disputes, the Bank reserves the right to require Cardholders to submit the relevant original transaction slips, other documents or evidence for verification. The submitted transaction slips, documents and/or evidence will not be returned. If there is any discrepancy between the Bank’s record and Cardholder’s record of any transaction, the Bank’s record shall prevail.
  12. Participation in the Promotion is subject to there being no abuse/non compliance by Cardholder, failing which the Bank will debit the values of the Offer from Cardholder’s account without notice and/or take such action to recover any outstanding amounts.
  13. The Bank may change the terms and conditions and/or modify or terminate the Promotion. The Bank’s decision is final.
  14. The English version shall prevail if there is any inconsistency between the English and Chinese versions.

 

General Terms and Conditions for DBS Credit Card Offers

  1. Unless otherwise specified, the promotion offers published in this webpage ("Offers") are only applicable to the cardholders of DBS Credit Cards and Co-branded Cards and DBS COMPASS VISA (excluding Business Card and Private Label Card) (“Applicable Credit Cards”) issued by DBS Bank (Hong Kong) Limited (the “Bank”) (“Cardholders”).
  2. To enjoy the Offers, Cardholders are required to settle payment with the Applicable Credit Cards.
  3. For Cardholders holding DBS Black American Express® Card, Offers are applicable to them only at merchants’ outlets (either physical or online) accepting American Express® Card for payment.
  4. Certain Offers are not valid on public holidays, eves of public holidays, festive days, eves of festive days and black-out days as designated by the merchants. Please contact the respective merchants for details.
